Welcome to SparkOnward (“SparkOnward”, “we”, “us”, “our”).

These Terms of Service (“Terms”) govern your use of sparkonward.com (the “Website”) and, where applicable, the purchase and participation in our services (coaching sessions, workshops, programs, and corporate services).

By using the Website, creating an account, registering for an event, or purchasing services, you agree to these Terms.

2. Services we provide

SparkOnward offers personal coaching, group workshops/programs, events, and corporate services on a commercial basis. We are not a BIG-registered healthcare provider; our work is coaching and advice, not therapy or treatment. The specific scope, duration, pricing, and delivery details are described on the Website or in a written proposal/confirmation.

Important boundary: Our services are not emergency, crisis, medical, psychiatric, or clinical treatment services. If you are in immediate danger or experiencing a mental health crisis, contact local emergency services.

3. Eligibility

  • You must be 18 years or older to use our services unless explicitly agreed in writing with guardian consent (and where legally permitted).

  • You confirm that the information you provide is accurate and up to date.

4. Booking, attendance, and participation

4.1 Sessions (1:1)

Unless stated otherwise:

  • Sessions are delivered online and/or in person as described at purchase.

  • You are responsible for your technology, connectivity, and a private space for online sessions.

4.2 Group programs, workshops, and events

  • Group spaces are limited. Your place is confirmed only once payment is completed (unless otherwise agreed).

  • You agree to participate respectfully and not disrupt the experience for others.

4.3 Confidentiality in groups

We treat participant sharing with care, but we cannot guarantee confidentiality in group settings because other participants are involved. By joining a group, you agree:

  • to keep what others share private, and

  • that Spark Onward is not liable for confidentiality breaches by other participants.

5. Payments, pricing, and invoices

  • Prices are shown on the Website or confirmed in writing.

  • Payment is due as specified at checkout or in the invoice terms.

  • If VAT applies, it will be stated on the invoice.

If your payment fails or is reversed (chargeback), we may pause or cancel your access until payment is resolved.

6. Cancellation and rescheduling

6.1 1:1 sessions

  • You may reschedule once if you provide at least 48 hours’ notice (unless your booking confirmation states different terms).

  • Cancellations or no-shows with less than 48 hours’ notice are charged in full.

If we need to reschedule due to illness or unforeseen circumstances, we will offer the next available slot or, if that’s not workable, a refund for the affected session.

6.2 Workshops / programs / events

Because group seats are limited, refunds depend on timing:

  • More than 14 days before start: full refund minus any non-refundable processing fees (if applicable).

  • 14 to 7 days before start: 50% refund.

  • Less than 7 days before start / after start: no refund.

You may transfer your place to another person with our written approval (to protect group fit and safety).

6.3 Corporate services

Corporate work is governed by the signed proposal / Master Services Agreement / SOW (Statement of Work). Where those terms conflict with these Terms, the signed agreement prevails.

7. Health, responsibility, and outcomes

You are responsible for your choices, actions, and decisions. We do not guarantee outcomes. Coaching can surface emotional material; by participating you agree to take responsibility for your wellbeing and seek additional support when needed.

We process your personal data as described in our Privacy Policy. Where coaching involves sensitive information, we rely on your explicit consent, which you give separately (for example on the intake form), and which you can withdraw at any time.

8. Intellectual property

All Website content and all materials provided in sessions/programs (including frameworks, worksheets, slides, recordings, and written resources) are owned by Spark Onward or licensed to us.

You may not copy, distribute, sell, or publish our materials without written permission, except for personal, non-commercial use.

9. Recording policy

Unless we explicitly agree in writing:

  • You may not record sessions, workshops, or group calls.

  • We will not record you without notice and your consent.

If a program includes replays, this will be clearly stated before purchase.

10. Acceptable use (Website and community)

You agree not to:

  • use the Website for unlawful purposes,

  • upload malware, scrape content, or attempt unauthorized access,

  • harass, threaten, or discriminate against others,

  • impersonate someone or misrepresent your affiliation.

We may restrict access if you violate these Terms.

11. Third-party services

We may use third-party tools (payments, booking, email, analytics). Your use of those tools may be subject to their terms. We are not responsible for third-party outages or changes outside our control.

12. Disclaimer and limitation of liability

The Website and services are provided “as is” and “as available.”

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential loss (including loss of profits, reputation, or business),

  • our total liability for any claim is limited to the amount you paid us for the relevant service in the 3 months before the event giving rise to the claim.

Nothing in these Terms limits liability where it cannot be limited under applicable law.

13. Termination

We may terminate or suspend access if you violate these Terms or behave in a way that undermines safety and integrity (especially in group settings). Where appropriate, we may offer partial refunds at our discretion.

14. Complaints

If you are unhappy with our services, please tell us first so we can try to resolve it together. If we cannot resolve it, an independent third party such as a mediator may be involved. As a commercial service provider we are not a healthcare provider, so the Dutch Wkkgz complaints scheme does not apply.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved informally will be submitted to the competent court in Amsterdam, unless mandatory consumer law requires otherwise.

16. Changes to these Terms

We may update these Terms periodically. The “Last updated” date will reflect changes. If changes materially affect your rights, we will take reasonable steps to notify you.
